The justices acted on a 5-4 vote, over dissents by Justices Ruth Bader Ginsburg, Stephen G. Breyer, Sonia Sotomayor and Elena Kagan. In a decision this month, however, the U.S. Court of Appeals for the D.C. Circuit struck down the injunction, arguing in part that the Mattis Plan is not a blanket ban on transgender people serving in the military. "DoD's proposed policy is NOT a ban on service by transgender persons", the Pentagon said in a statement, adding that the policy was based on "professional military judgment and will ensure that the U.S. Armed Forces remain the most lethal and combat effective fighting force in the world".
If the justices do decide to take up the matter, the earliest it would be heard is in October, the court's next session. The cases will continue to move through lower courts.
Trump caught the Pentagon by surprise in July 2017 when he announced through a series of three tweets that he would ban transgender individuals from military service, reversing a 2016 policy announced by Carter. But the high court for now declined to take up cases about the plan.
The ban seemed to take Defense Department officials by surprise, sparking confusion despite Trump's assertion that he had consulted with "with my Generals and military experts".
Federal courts had blocked the administration's original policy, finding that it likely violated the U.S. Constitution's guarantee of equal protection under the law. But it has an exception for transgender troops who relied on the Obama-era rules to begin the process of changing their gender.
"Unfortunately, the court's stay of the lower courts' preliminary orders means that courageous transgender service members will face discharges while challenges to the ban go forward".

While Mr Trump's rationale for banning transgender troops was financial, according to estimates by the RAND Corporation, a policy think tank working with the US Armed Forces, transition-related healthcare costs are between $2.4m (£1.8m) and $8.4m per year.
