The president has railed against the 9th Circuit Court after a federal judge in Northern California ordered a temporary restraining order against the Trump administration from barring migrants who cross the southern border illegally seeking asylum.
Trump then told an Army colonel that his troops were getting better equipment than ever before after spending months lambasting the previous administration on military spending, and said to another interlocutor that the nation was doing better than ever in another tribute to his leadership.
When the Supreme Court hears a case, it is more likely to overturn it than not.
A PolitiFact investigation in 2017 found that the Supreme Court overturned 79% of cases it reviewed from the 9th Circuit from 2010 to 2015, though less than 1% of the total number of cases ruled by the circuit court got overturned.
As for Tigar, he said, "This was an Obama judge".
We do not have Obama judges or Trump judges, Bush judges or Clinton judges.
He continued, "I think that the president is so dominant, to some extent, I would, if I were Chief Justice Roberts ..."
"I understand his desire to express the sentiment - one that I agree with - that judges owe fidelity to the Constitution and the law, and not to a political party or ideology", said Malcolm, who is vice president for the Institute for Constitutional Government and director of the Meese Center for Legal and Judicial Studies.Читайте также: Oprah Winfrey's Mother, Vernita Lee, Dies on Thanksgiving Day at 83

"The 9th Circuit, everybody knows that it's totally out of control".
The selection of federal judges has become a political and increasingly hyper-partisan and polarizing process - as Democrats have long made abundantly clear in their vitriolic attacks on conservative judicial nominees.
The president said he respects Justice Roberts, but said "common sense" is needed to handle the 9th Circuit. Roberts steadfastly maintained his silence through all of this, even when Trump called him a "nightmare for conservatives", just before the inauguration.
Trump's appointments to the Supreme Court and lower federal courts have themselves spurred charges that the courts are becoming more politicized.
But "judge shopping", as Trump put it when railing against court decisions on immigration past year, is not that straightforward. "People should not be allowed to immediately run to this very friendly circuit and file their case".
That court has ruled against Mr Trump in several high-profile cases, including his travel ban targeting people from several Muslim-majority countries and his bid to rescind a programme that protects from deportation hundreds of thousands of illegal immigrants brought into the country as children. "And the 9th Circuit is really something we have to take a look at, because it's not fair". Some Republicans in 9th Circuit states have proposed splitting the circuit in two, but legislation has not advanced.
Former special assistant to President George W. Bush, Scott Jennings, told CNN Thursdaythe ideological shift on the court may have compelled Roberts to defend the courts. But Trump has the opportunity to narrow that edge significantly because there are six vacancies, and he already has nominated candidates for five of them.При любом использовании материалов сайта и дочерних проектов, гиперссылка на обязательна.
