The 15-1 judgement of the ICJ in the Kulbhushan Jadhav case may have political and diplomatic ramifications for Pakistan as the Chinese jurist and Vice President of the world court backed the majority judgement, signalling a setback for Islamabad in the high-profile verdict.
India alleged that Pakistan is in breach of Article 36 (1)(b) of the Vienna Convention which obliged Pakistan to inform India of the arrest of Jadhav "without delay".
The court rejected all the objections of Pakistan, including one unanimously on the admissibility of the case and also the claims by Islamabad that India had not provided the actual nationality of Jadhav. Xue, who studied law in Peking University and Columbia University School of Law has been part of the Chinese Foreign Ministry since 1980.
India has also claimed that Pakistan violated the Vienna Convention by failing to provide consular access to Jadhav, which is the ability to consult embassy officials of their own country in a foreign nation.
Harish Salve said that ICJ directed a fair trial in accordance with the Pakistan constitution but if it's back in the military court with the same rule where outside lawyers aren't allowed, the evidence isn't given then it won't meet standards.
He said that India had raised five points in the ICJ and nearly all of them were overturned by the International Court of Justice in its verdict.
He confessed before a Magistrate and the Court that he was tasked by RAW to plan, coordinate and organize espionage / sabotage activities aiming to destabilize and wage war against Pakistan by impeding the efforts of Law Enforcement Agencies for restoring peace in Balochistan and Karachi. For New Delhi, Jadhav is the latest victim of longstanding Pakistani efforts to spin false narratives that wrongly implicate India and its nationals.
It reiterated that Jadhav entered Pakistan without a visa on authentic Indian passport with a fake alias Hussain Mubarak Patel.
Jadhav, 49, a retired Navy officer, was arrested allegedly on March 3, 2016, and India was informed on March 25.
The verdict will come days after a meeting between Indian and Pakistani delegates at the Wagah border to finalise the modalities of the Kartarpur corridor for Sikh pilgrims.
Kulbhushan Jadhav's friends watched the telecast wearing "India with Kulbhushan" T-shirts and also offered special prayers ahead of the ICJ verdict.
India insists that Jadhav was not a spy and was abducted by authorities, while Pakistan says he operated a network of operatives in the restive Balochistan province, coordinating attacks by armed groups. Its approach to the ICJ stopped Pakistan from executing Jadhav.
