Elon Musk is set to face trial after calling a diver who helped rescue the Thai schoolboys trapped in a cave a "pedo" in a tweet.
Tesla didn't immediately respond to a request for comment.
While Unsworth put together a team of United Kingdom cave divers who helped free the boys trapped by rising water levels in a cave in July past year, Musk's Tesla engineers built a small submarine and sent it to Thailand to assist in a rescue effort.
The judge had on April 26 denied Musk's bid to dismiss the lawsuit brought by diver Vernon Unsworth, without explaining his reasoning.
Unsworth, was the first foreigner on the scene and played a key role in getting all 13 people out of the cave safely, he reportedly said at the time, quoted by CNN, that Musk's proposal was "just a PR stunt" that "had absolutely no chance of working".

Musk contended his insult was protected from legal action, but the judge overseeing the case disagreed.
But the judge said Musk was not communicating in "heated and volatile" settings that might explain any excesses.
"There is nothing about the context in which [Musk ] made the statements.that would create doubt as to whether [Musk's] statements implied assertions of objective fact", Wilson wrote.
Wilson said in a footnote he has not found that reasonable jurors would "necessarily" view Musk's comments as factual.
Unsworth is seeking more than $75,000 in damages from Musk, a multibillionaire.
Following the move, Unsworth announced that he started preparing legal action against Musk for defamation in the courts of Thailand, where Musk could get a jail sentence for his remarks.
The case is Unsworth v Musk, US District Court, Central District of California, No. 18-08048.
