Trump declared the national emergency on Friday and shortly after his announcement, the American Civil Liberties Union tweeted that it would be suing the president. That is exactly the case here: "Congress has authorized a wall and other security measures at the border, it has not passed any law forbidding such a wall, and the president has invoked delegated powers to continue the wall's construction".
Critics of the move cite the separation of powers clause in the Constitution and say that the President is overreaching his executive authority.
Stephen Miller, a senior White House adviser, told Fox News on Sunday that the declaration would allow the administration to build "hundreds of miles" of border wall by September 2020.
